Terms of Service

Nerva IR is a personal cyber-incident assistant. It helps individuals assess suspicious messages and links, and guides them through containing and recovering from cyber incidents such as phishing, account compromise, and financial scams.

Nerva IR provides information, analysis, automated checks, and step-by-step guidance. It is a support tool. It is not a substitute for professional legal, financial, forensic, or law-enforcement advice, and it does not act on your behalf with banks, platforms, or authorities.

Security is probabilistic, not absolute. No product — including Nerva IR — can detect every threat or guarantee that you will avoid harm.

You acknowledge and accept that:

• Nerva IR may classify a malicious message as safe (a false negative) or a legitimate message as dangerous (a false positive).
• Threat intelligence, breach data, and reputation signals come from third parties, may be incomplete, delayed, or wrong, and can change at any time.
• Guidance is generated from general patterns and the limited information you provide; it may not fit your specific situation.
• The Service may be unavailable, interrupted, or delayed, and features may change or be removed.

The Service is provided for informational purposes to help you make your own decisions. It does not create a security-monitoring, managed-service, or fiduciary relationship of any kind.

You are solely responsible for your own devices, accounts, credentials, money, and data, and for every decision you make — including decisions influenced by output from the Service.

Before acting on any analysis or recommendation, you should use your own judgement and, where the stakes are meaningful, independently verify the information (for example, by contacting your bank or the relevant provider through a channel you know to be genuine) and seek qualified professional help.

Nerva IR will never ask you to disclose passwords, one-time codes, or full card numbers, and will never tell you to send money or hand control of a device to anyone. Treat any message that does so as fraudulent, regardless of how it reached you.

You agree to use the Service only for lawful purposes and only in connection with your own security or that of people you are helping with their consent.

You must not:

• submit content you have no right to submit, or that contains other people's personal data without a lawful basis;
• use the Service to attack, probe, scan, overload, or reverse-engineer any system, or to develop or refine malware, phishing, or fraud;
• rely on the Service as your only security control, or represent its output to others as a definitive verdict;
• misuse, automate, resell, or attempt to circumvent rate limits, access controls, or usage quotas;
• upload unlawful, infringing, or malicious material except the minimum needed to have a suspicious item analysed.

If you use the Service in a way that these Terms prohibit, any resulting loss is your responsibility, and we may suspend or terminate your access without notice.

You must provide accurate registration information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorised use.

You must be at least 18 years old, or the age of majority where you live, to create an account.

The Service integrates data and tools from third parties and may point you to external websites, providers, or authorities. We do not control and are not responsible for third-party content, availability, accuracy, or practices. Any dealings you have with a third party are solely between you and that third party.

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will detect or prevent any particular threat, loss, or harm.

To the fullest extent permitted by law, HardSoft Security and its people will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, money, profits, goodwill, or opportunity, arising out of or relating to your use of, or inability to use, the Service — including losses caused by a threat the Service did not detect, by guidance that did not fit your situation, or by your own actions.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence.

You agree to indemnify and hold harmless HardSoft Security from any claim, liability, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, your violation of any law, or your infringement of any third party's rights.

Paid features are billed in advance through our payment provider on the cycle shown at checkout. Except where required by law, payments are non-refundable. You can cancel at any time; access continues until the end of the paid period. Prices and plan contents may change on notice for future billing cycles.

We may suspend or terminate your access at any time if you breach these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. You may stop using the Service and close your account at any time.

We may update these Terms from time to time. If a change is material we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Spain, without regard to conflict-of-laws rules. The courts of Spain will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
